Appeals

Used to resolve disputes with a regional or developmental center about eligibility for services or the nature, scope, or amount of services and supports a person should be receiving. Anyone aged 3 or older who has applied for regional center services, or who currently is receiving regional center services, can appeal regional center decisions they do not agree with.

Community Resource Development Plan

In 2017, the Lanterman Act was amended to allow the Department of Developmental Services (DDS) to provide funding for Regional Centers to develop resources to address unmet needs in their community with certain guidelines (WIC Sections 4418.25  & 4679). This is referred to as Community Resource Development Plan/Community Placement Plan (CRDP/CPP) funding.

Conflict of Interest

The conflict of interest policy and standards adopted by the board of directors ensure that regional center board members and employees act in the course of their duties solely in the best interest of the regional center clients and their families, without regard to the interests of any other organization with which they are associated or persons to whom they are related.

Guidelines to Mitigate Conflicts for Delegated Conservatorships

This policy is developed to mitigate conflicts that may arise when a regional center is the delegated conservator while also providing service coordination to the conservatee. It will also address the process a conservatee or their legal representative may use if they are dissatisfied with the way the regional center is carrying out its delegated conservatorship responsibilities.

HCBS Final Rule

The CMS Final Rule specifies that federal funds cannot be used to fund segregated services for persons with disabilities effective March 17, 2019.

 

HCBS Waiver Program

DDS contracts with 21 private, non-profit corporations to operate regional centers, which are responsible under state law for coordinating, providing, arranging or purchasing all services needed for eligible individuals with developmental disabilities in California. All HCBS Waiver services are provided through this system. It is the responsibility of DDS to ensure, with the oversight of DHCS, that the HCBS Waiver is implemented by regional centers in accordance with Medicaid statute and regulations.

Request for Proposal Policy

This is Lanterman’s board-approved policy for entering into contracts valued at over $250,000 annually and the process for issuing requests for proposals (RFPs) to address client service needs, and for awarding and disbursing start-up funds for new resource development, when available.

Transparency and Public Information

In order to promote transparency and accountability and maintain the trust or our community, Lanterman Regional Center provides timely access to public information about the center and about services we purchase. While providing access to information we also comply with applicable federal and state law relating to the confidentiality of client information and records.

Whistleblower Policy

The DDS policy outlines the Department’s process for handling whistleblower complaints regarding alleged improper activity by regional centers or vendors/contractors. The policy, including the definition of regional center or vendor/contractor whilstleblower complaints, confidentiality, about filing a complaint and how to file a complaint are all posted on the DDS Web site Complaint page.

Zero Tolerance Policy

The Regional Center has a “Zero Tolerance” Policy with regard to Client abuse and neglect.
